De una parte, se ha trascendido el antiguo paradigma monumental; de otra, el patrimonio se ha extendido a innumerables ámbitos epistemológicos y prácticos que lo interpretan y aplican según sus intereses.Desde una perspectiva teórica, este trabajo pretende una aproximación conceptual al patrimonio cultural a través de algunas claves que deberían estar presentes en toda reflexión patrimonial. In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...) a need to identify the most effective means to shield legal assets, which allows for an imputation of passive conducts, despite having an active typical description. This introduces the controversial figure of the improper omission, which is used with the function of perfecting all of the structural elements of the criminal conduct. When an individual knows he is in a position of guarantor and is aware of the potential consequences, but fails to take action, having the means to prevent a foreseeable outcome, this device serves to enhance the criminal protection of legal assets, fostering social solidarity as the basis of the criminal justice system. This system, by satisfying the function of general prevention of the punishment, ideally dissuades the individual from committing crimes with the threat of penalty. These theories are fundamental to understanding criminal responsibility by improper omission in the context of the objective imputation theory. By guiding the evolution and delimitation of its application, they serve as a significant factor in criminal social control in Colombia. (shrink)

En este artículo realizo una lectura de la propuesta historiográfica de José Luis Romero y de la “Historia social de la literatura” de Rafael Gutiérrez Girardot, mostrando cómo la primera influye en la segunda, y relacionándolas con el problema de la identidad de América Latina. Se parte de un diagnóstico de la historiografía colombiana del siglo XX y se evidencia la manera como estas dos miradas historiográficas lograron superar las deficiencias de la misma, fundando en nuestro continente una (...) utopía política que aboga por una conciencia de América. The present qualitative study analyzes how a group of young people already involved in STEM fields perceive the prototypical person working in STEM. Gender differences between participants in technological and non-technological STEM fields were analyzed. A total of 27 young people (59.3% women) took part in the interviews (Mean Age = 25.48 years). Of them, 16 participants were working in STEM professions, and 11 were enrolled in the final courses of STEM degrees. The results of the content analysis were examined (...) in light of social role theory and the multidimensional structure of gender stereotypes. Men in these fields were therefore attributed an unappealing and weird physical appearance. Some female participants linked STEM professionals’ intellectual abilities to the stereotype that men have higher abilities in these fields. Whereas females attributed effort and perseverance to STEM professionals’ intellectual aptitudes, males referred to the development of soft skills. Participants in technological STEM fields connected the stereotype of being a ‘weirdo’ to a boring job, whereas those in non-technological fields linked it to their unconventional character. Some participants were disappointed by a lack of correspondence between expectations and the actual job STEM professionals do. Moreover, females in technological STEM fields commented on the job’s low social impact, while males mentioned low attainment of technical qualifications. Most referents in STEM fields were masculine, some of whom were present in the mass media. The practical implications of the findings are discussed. (shrink)

Edith Stein leyó la obra de Martin Heidegger Ser y tiempo en 1927, el mismo año de su publicación. Este artículo trata de reconstruir la «hermenéutica blanca» de esa lectura, es decir, las reacciones que pudo suscitar y que no fueron puestas por escrito en ese momento. Se toman como guía tres comentarios azarosos de la autora en relación tanto a Ser y tiempo como a la filosofía de Heidegger en general. Edith Stein read Martin Heidegger’s Being and Time in (...) 1927, the year of its publication. This article explores a «white hermeneutics» of her reading, tracing some possible reactions to this work that Stein did not record at the time. Bovens (2010) points out that there is a structural analogy between the Judy Benjamin problem (JB) and the Sleeping Beauty problem (SB). On grounds of this structural analogy, he argues that both should receive the same solution, viz. the posterior probability of the eastern region of the matrix in Table 1 should equal 1/3. Hence, P*(Red) = 1/3 in the JB and P*(Heads) = 1/3 in the SB. Bovens’s argument rests on a standard error in implementing Bayesian updating, which is (...) spelled out in Shafer 1985. When we are informed of some proposition, we do not only learn the proposition in question, but also that we have learned the proposition as one of the many propositions that we might have learned. The information is generated by a protocol, which determines the various propositions that we might learn. We should then update not on the proposition in question, but rather on the fact that we learned this proposition as one of the many propositions that we might have learned. A well-known application of this insight is the Monty Hall problem (MH) as Speed (1985: 276) points out in a discussion of Shafer 1985. As an illustration, let us apply Shafer’s insight to the MH. In the MH, the contestant in a game show learns that there is a goat behind two of three doors X, Y and Z and a car behind one door. She is asked to pick one of the three doors. The contestant picks door X. Monty will then open one of the remaining doors, which he knows to have a goat behind it. Suppose Monty opens door Y. The contestant is then asked whether she wants to …. Resumen. La presente investigación busca diseñar un modelo estratégico de formación de servidores públicos que propicie el crecimiento personal y profesional, encaminado al servicio civil de carrera. Apoyándose en criterios, conceptos y estrategias propios de Administración del Capital Humano, y Aprendizaje Organizacional aplicándolas al contexto de la Administración Pública Estatal. Para alcanzar este propósito se realizó un diagnóstico con beneficios claros, que dan la oportunidad de pensar y dialogar sobre la estrategia, los objetivos, las personas y el futuro de la (...) Administración Pública Estatal Sinaloense desde una perspectiva del conocimiento. El trabajo de campo se realizó con personal que presta sus servicios en entidades y dependencias administrativas públicas pertenecientes al Poder Ejecutivo del Gobierno del Estado de Sinaloa. A través de un cuestionario, con una muestra de 400 individuos. Se han obtenido 29 indicadores cuyos valores reflejan donde reside el valor del Capital Humano. Así como una puntuación total alcanzada de 104 puntos, advirtiéndose que en el área de gestión del conocimiento, es necesario hacer “algo” para que esta administración, sea considerada como una organización que aprende en toda regla y que realiza una gestión del conocimiento de forma óptima y eficaz. The present research pretends to design a strategic model to train public servants to help to develop both professional and personal growth, headed to civil service as a profession. Based on criteria, concepts and strategies from Human Capital Administration and Organizational Learning, applying these to the State Public Administration’s context. To achieve this goal, a diagnose took place with clear benefits, that give, to us all, the chance to think and discuss about strategies, objectives, people and future of the Sinaloa State Public Administration from a knowledge perspective. Fieldworkwas done by personnel that serve in administrative public entities and organizations that are part of the Executive Power of the Sinaloa State Government. Through a questionnaire, with a sample of 400 individuals, there was a result of 29 indicators, and its values reflect where the importance of the Executive Power of the Sinaloa State Government lies, as well as a reached total score of 104 points. Noting that in the knowledge promotion area it is necessary to do something so this administration would be considered an organization that learns with every rule and performs a knowledge management in an optimum and efficient way. Philosophers have often argued that ascriptions of content are appropriate only to the personal level states of folk psychology. Against this, this paper defends the view that the familiar propositional attitudes and states defined over them are part of a larger set of cognitive proceses that do not make constitutive reference to concept possession. It does this by showing that states with nonconceptual content exist both in perceptual experience and in subpersonal information-processing systems. What makes these states content-involving is their (...) satisfaction of certain basic conditions deriving from a general account of representation-driven behaviour that is neutral on the question of concept possession. It is also argued that creatures can be in states with nonconceptual content even though they possess no conceptual abilities at all. (shrink)

In a recent paper, Fredérique de Vignemont has argued that there is a positive quale of bodily ownership . She thinks that tactile and other forms of somatosensory phenomenology incorporate a distinctive feeling of myness and takes issue with my defense in Bermúdez of a deflationary approach to bodily ownership. That paper proposed an argument deriving from Elizabeth Anscombe’s various discussions of what she terms knowledge without observation . De Vignemont is not convinced and appeals to the Rubber Hand Illusion (...) to undercut my appeal to Anscombe. Section 1 of this article restates the case against the putative quale of ownership. Section 2 explains why de Vignemonts’ objections miss the mark. Section 3 discusses in more detail how to draw a principled distinction between bodily awareness and ordinary perceptual awareness. My topic in this paper is social understanding. By this I mean the cognitive skills underlying social behaviour and social coordination. Normal, encultured, non-autistic and non-brain-damaged human beings are capable of an impressive degree of social coordination. We navigate the social world with a level of skill and dexterity fully comparable to that which we manifest in navigating the physical world. In neither sphere, one might think, would it be a trivial matter to identify the various competences which underly this (...) impressive level of performance. Nonetheless, at least as far as interpersonal interactions are concerned, philosophers show a rare degree of unanimity. What grounds our success in these interactions is supposed to be our common mastery of folk psychology. (shrink)

The author challenges the view that birth cannot be a morally relevant fact in the process of development from zygote to child. He reviews specific arguments against giving any moral significance to the fact of birth. Drawing on recent work in developmental psychology, he contends that the lives of neonates can have a level of self-consciousness that confers moral significance but can only be possessed after birth. He shows that the position he has argued for provides a framework within which (...) the move from the moral validity of aborting sentient fetuses to the moral validity of infanticide might be resisted. He concludes that arguments suggesting that birth can be morally significant support the view that the acquisition of moral significance is a gradual and multilayered phenomenon. (shrink)

This commentary defends intentionalist accounts of self-deception against Mele by arguing that: (1) viewing self-deception on the model of other-deception is not as paradoxical as Mele makes out; (2) the paradoxes are not entailed by the view that self-deception is intentional; and (3) there are two problems for Mele's theory that only an intentionalist theory can solve.

The aim of this article is to examine a new set of difficulties for evaluating counterfactuals that arise in the context of the dynamical spacetimes described by the theory of general relativity. The initial value formulation provides us with a methodology to pin down the specific combination of features of the theory at the origin of the difficulties, namely, non-linearity and certain non-local aspects, in particular when combined with (...) the global and/or quasi-local character of physical quantities in general relativity. Finally, we connect the philosophical question about counterfactuals with concrete applied physical issues in general relativity about extracting meaningful predictions by constructing appropriate initial data sets, leading us to question the very suitability of the Cauchy approach to fully account for the explanatory power of the theory. This paper argues that, while there is a difference between personal and sub-personal explanation, claims of autonomy should be treated with scepticism. It distinguishes between horizontal and vertical explanatory relations that might hold between facts at the personal and facts at the sub-personal level. Noting that many philosophers are prepared to accept vertical explanatory relations between the two levels, I argue for the stronger claim that, in the case of at least three central personal level phenomena, the demands of explanatory (...) adequacy require postulating horizontal explanatory relations. What is the relation between philosophical theorizing and experimental data? A modest set of naturalistic assumptions leads to what I term the force-field puzzle. The assumption that philosophy is continuous with natural science, as captured in Quine’s force-field metaphor, seems to push us simultaneously towards thinking that there have to be conceptual constraints upon how we interpret experimental data and towards thinking that there cannot be such conceptual constraints, because all theorizing must be accountable to data and observation. The key (...) to resolving the force-field puzzle is to take a more nuanced view of how conceptual constraints can be accountable to data and observation. This can be done by developing conceptual arguments in conjunction with interpretative frameworks for making sense of experimental evidence. This paper shows how attending to important differences between different types of mindreading yields tools for interpreting experimental and observational data in a manner consistent with a (conceptually derived) constraint that I have developed elsewhere. This is the first-order constraint that second-order thinking, or thinking about thinking, is only available to language-using creatures. (shrink)

It provides a notably crisp and clear treatment of some extremely intriguing topics." -- Jane Heal, Department of Philosophy, University of Cambridge In this book, José Luis Bermú dez addesses two fundamental problems in the philosophy and psychology of self-consciousness: (1) Can we provide a noncircular account of fully fledged self-conscious thought and language in (...) terms of more fundamental capacities? (2) Can we explain how fully fledged self-conscious thought and language can arise in the normal course of human development? Bermú dez argues that a paradox (the paradox of self-consciousness) arises from the apparent strict interdependence between self-conscious thought and linguistic self-reference. The paradox renders circular all theories that define self-consciousness in terms of linguistic mastery of the first-person pronoun. It seems to follow from the paradox of self-consciousness that no such account or explanation can be given. Drawing on recent work in empirical psychology and philosophy, the author argues that any explanation of fully fledged self-consciousness that answers these two questions requires attention to primitive forms of self-consciousness that are prelinguistic and preconceptual. Such primitive forms of self-consciousness are to be found in somatic proprioception, the structure of exteroceptive perception, and prelinguistic forms of social interaction. The author uses these primitive forms of self-consciousness to dissolve the paradox ofself-consciousness and to show how the two questions can be given an affirmative answer. (shrink)

A central discussion in the theory of deliberative democracy in recent decades has focused on whether democratic deliberation, and consequently those participating in it, should aim, at least ideally, for political consensus. Thus, pluralist deliberative democrats have criticized the consensualist approach to deliberative democracy for neglecting the moral importance of political disagreement because of their fixation with reaching consensus. The debate between these two positions, initiated in the 1990s, has evolved in recent years toward more precision and sophistication. However, some (...) vagueness and ambiguities remain in many of the contributions and prevent us from getting an exact idea of the object of discussion. This article starts making further distinctions about several types of agreement and disagreement in order to clarify much more precisely the exact niche of dispute between these two views. They do not need to disagree on the value of many forms of disagreement and consensus. Their dispute consists only in a controversy about the relative value of post-deliberative, operative, substantive, legislative, regulatory, or adjudicative reason-based consensus as opposed to the corresponding reason-based disagreement. Finally, the article argues that this relatively small niche is made smaller by certain considerations. The most important of them is that this controversy remains at a high theoretical level and lacks practical importance: it only affects the kind of personal ideal commitment or aspiration that virtuous deliberators should have when entering into a deliberative process, and has no concrete consequent institutional implications. Debates about bodily ownership and psychological ownership have typically proceeded independently of each other. This paper explores the relation between them, with particular reference to how each is illuminated by psychopathology. I propose a general framework for studying ownership that is applicable both to bodily ownership and psychological ownership. The framework proposes studying ownership by starting with explicit judgments of ownership and then exploring the bases for those judgments. Section 3 discusses John Campbell’s account of ψ-ownership in the light of (...) that general framework, emphasizing in particular his fractionation of ψ-ownership into two dissociable components. Section 4 briefly presents an account of φ-ownership that I have developed in more detail elsewhere. Section 5 explores the suggestion, originating with Alexandre Billon, that there needs to be an integrated account of φ-ownership and ψ-ownership because depersonalization disorders typically involve breakdowns of both φ-ownership and ψ-ownership. The argument from depersonalization is not compelling, but Section 6 proposes a different way of reaching the same conclusion. Section 7 shows how reflecting on agency and practical reasoning offers a common thread between the models of φ-ownership and ψ-ownership discussed earlier in the paper. (shrink)
